Texas moves to exempt healthcare technology from sales tax

October 9, 2026

The Texas Comptroller signed an executive order directing the agency to publish a proposed amendment to Rule 3.342. The amendment would exempt electronic health record (EHR) and electronic medical record (EMR) systems, patient portals, and other healthcare technology systems from sales tax. The change applies to the state’s rule on information services.

The bottom line: The Comptroller has not made a final decision. If the agency adopts the amendment, healthcare technology providers selling into Texas should review which products qualify for the exemption and update their tax settings. Watch for the published proposed amendment to confirm the exact scope.
